Background:Allen M.Campbell Co.(plaintiff),in August 1981,intended to bid on a Department of Navy contract to construct housing for enlisted personnel at Camp Lejeune,North Carolina.The deadline for submission of bids was 2:00 P.M.on August 11,1981.At about i'30 P.M.,Virginia Metal Industries,Inc.(defendant),telephoned Campbell and quoted a price to supply all hollow metal doors and frames required by the plans and specifications.The price quoted was $193,t 21,plus applicable taxes.Campbell based the computation for its bid for the Navy project upon the quoted price for the hollow metal doors and frames of $193,121 and taxes.Campbell was the successful bidder and was awarded the Navy contract.Virginia Metal backed out of quoted price of $193,121 from another supplier,at a cost $45,562 greater than what it had been led to expect Virginia Metal would charge.Campbell sued Virginia Metal Industries,Inc.for the $45,562.The trial court dismissed Campbell's complaint,and Campbell appealed to the Fourth Circuit Court of Appeals.
Decision:Ruling for Campbell,the Fourth Circuit Court of Appeals reversed the trial court decision and sent the case back to the trial court for trial.
