Issuing Bank
The bank that issues the documentary credit on behalf of the applicant is called the issuing bank or opening bank.By issuing a credit the issuing bank undertakes full responsibility for payment against proper documents presented by the beneficiary.Such an undertaking of the issuing bank is substituted for that of the applicant,namely,the mercantile credit is replaced by bank credit.
According to UCP 500 Article 9 a.:“…if the Credit provides for acceptance,(a) by the Issuing Bank—to accept Draft(s) drawn by the Beneficiary on the Issuing Bank and pay them at maturity or (b) by another drawee bank—to accept and pay at maturity Draft(s) drawn by the Beneficiary on the Issuing bank in the event the drawee bank stipulated in the Credit does not accept Draft(s) drawn on it,or to pay Draft(s) accepted but not paid by such drawee bank at maturity.”
三、 开证行
在申请人的委托下开跟单信用证的银行叫做开证行.信用证自
开立之日起开证行就应对受益人对于支付所提供的文件承担全部责任,这种责任是开证行代替申请人承担的,也就是说以银行信誉代替商品的信用.
根据《跟单信用证统一惯例》500出版物第9条a项规定：“……如果要使信用证方便开证行承兑——开证行就得接受受益人对其开具的汇票并且在时机成熟时开证行本身或者是另一个付款行承兑汇票——如信用证上规定的付款银行对以其为付款人的汇票不予承兑时,应由开证行承兑并在到期日支付受益人出具的以开证行为付款人的汇票；或者,如受票银行给予承兑汇票,但到期不付时,则开证行应予支付.”
